
On 19 May 2025, our Associate, Mr. Ignatius Ng delivered an insightful CPD Talk on the legal framework governing building or facilities management,
covering their duties, powers, and common challenges under Hong Kong’s Building Management Ordinance (BMO) and Deed of Mutual Covenant (DMC).
The session provided practical insights through case examples, thought-provoking discussions, and real-world scenarios.
The talk explored (1) the statutory duties and powers of Incorporated Owners (“IOs”), (2) the definition of common parts in a building, (3) the duty of care owed by IOs, (4) the power of entry and inspection in emergencies, (5) the impact of special clauses in the DMC, (6) common complaints faced by IOs, and (7) the liability of IOs upon winding up.
Mr. Ng demonstrated the power of interactive learning by framing key concepts through real-world questions from owners. He engaged participants with scenarios: "Should the waterproofing layer be considered a common part?" This prompted attendees to recognize that such installations exist for the collective benefit of all owners, not just individual units. Similarly, when addressing the common protest—"If corridors are shared spaces, why can’t I use them as I please?"—he guided the group to reframe the issue: while common areas belong to everyone, responsible usage like keeping pathways clear ultimately ensures safe, equitable access for the entire community. Mr. Ng transformed legal concepts into practical, relatable insights.
